Terms of Service — Family Beacon

Agreement to Terms

By downloading or using Family Beacon (“the App”), you agree to be bound by these Terms of Service.

Description of Service

Family Beacon is a location sharing application that allows users to send their current location to family members and receive location beacons from them. The App uses Apple’s iCloud infrastructure to transmit and store data. The Service Provider does not operate any servers and has no access to your data.

Intended Use

This App is intended for:

• Sharing your location with trusted family members or close contacts
• Receiving location information from family members who choose to share with you
• Personal, non-commercial use

This App is not intended for:

• Tracking individuals without their knowledge or consent
• Surveillance or stalking of any kind
• Commercial location tracking or fleet management
• Use by individuals under 13 years of age without parental supervision

User Responsibilities

By using the App, you agree that:

1. You will only share your location with individuals who have consented to receive it
2. You will not use the App to track any person without their explicit consent
3. You are responsible for managing who has access to your location through the App
4. You will comply with all applicable laws regarding location sharing and privacy in your jurisdiction
5. You understand that location sharing requires an active internet connection and iCloud account

Consent and Privacy

Family Beacon is designed so that all location sharing is voluntary and initiated by the sender. You agree to respect the privacy of others and not to:

• Pressure family members to share their location against their will
• Misuse location information you receive through the App
• Share another person’s location data with third parties without their consent

iCloud Dependency

The App relies on Apple’s iCloud and CloudKit services. The Service Provider is not responsible for:

• Service interruptions or outages caused by Apple’s iCloud infrastructure
• Data loss resulting from iCloud sync issues
• Changes to Apple’s iCloud services that may affect App functionality

Disclaimer

The App is provided for personal family use only. The Service Provider is not responsible for:

• Inaccuracies in location data provided by your device’s GPS or network
• Missed or delayed beacon notifications
• Any harm arising from reliance on location information provided by the App

Limitation of Liability

To the maximum extent permitted by law, Jeffrey Ellin and the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, privacy breaches caused by third parties, or other intangible losses resulting from your use of the App.

Intellectual Property

The App and its original content, features, and functionality are owned by Jeffrey Ellin and are protected by international copyright, trademark, and other intellectual property laws.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by updating the “Last Updated” date. Continued use of the App after changes constitutes acceptance of the new terms.

Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
